Following the testimonies, the city council unanimously voted to decriminalize the drug, along with peyote. In January 2020, Santa Cruz, California, voted unanimously to decriminalize the adult possession and cultivation of psilocybin. Commercial sale of psilocybin is still illegal.

California Health & Safety Code Section 11390. This means that, depending upon the circumstances, a person suspected of unlawful cultivation of mushrooms faces the possibility of a felony arrest and conviction with an exposure of up to three years in the state prison.

Psilocybin (mushrooms) Psilocybin and its metabolized counterpart psilocin are Schedule 1 on the California Uniform Controlled Substances Act. Mushrooms containing psilocybin and psilocin, as well as psilocybin mushroom spores are illegal to possess, import, buy, sell, trade, or give away if intended to be cultivated.
