You're not going to get drug test AT court. At least I don't think, I've never heard that done. I don't know where you live, or what kind of trouble you could be looking at for the possession, but you very well may find yourself reporting to a probation office or some place like that, and they'll test you.

Yes, you definitely need to hire an attorney to represent you. Do not plead guilty. They won't make you take drug tests at court. If you have no prior convictions, depending on the court, it's possible that your attorney can get this reduced to a lesser offense, such as Littering. You may have to take a court-ordered drug education class, pay a fine and court costs, or you might have to accept an SIS (suspended imposition of sentence) and probation to keep it off your record. Aside from the primary reasons discussed above, a court may order drug testing when there is evidence of use, such as witness testimony, recent drug-related convictions, or prior drug habits. This is especially true when one of the parties accuses the other of being a drug user. The court will not just take the word of the accuser, they will ask for proof. The court may also require the accusing party to take a drug test as well.

The courts may only order drug and alcohol testing done in the least intrusive method. Typically, this means only urine samples. The court cannot demand hair follicle testing even though this method produces more accurate results for a longer time. It’s important to remember that a positive result on a drug or alcohol test does not automatically mean an adverse outcome in the custody determination for the parent who tested positive. Test results also are restricted against use beyond the ...

A court may refuse to give custody to a parent accused of drug or alcohol abuse, or that parent may only be allowed supervised visitation. Because accusations of drug or alcohol abuse are taken so seriously, it is often not enough to simply tell the court that your former spouse or partner has abused these substances. Instead, you may need to ask the court to order a parent to take a drug test and prove that he or she is capable of caring for a child.

A court does not order drug tests without evidence. Because this is an extremely invasive step, the court takes it seriously. Depending on where you live, some states even require both parents to submit to a drug test when an accusation is made and evidence is presented. If a test comes back positive, the court uses this information in determining child custody. Courts can even terminate parental rights because of drug use. By taking these steps, the court is only looking to make sure your ...
